What happened before

The Verkhovna Rada of Ukraine has adopted a new law that introduces an additional ground for dismissal of employees. According to the draft law No. 7731, employers can now terminate an employee's employment contract if the employee fails to report relatives or close friends who are in the temporarily occupied territories.

This draft law was registered in 2022 by a group of MPs from the Servant of the People faction and recently received the support of the majority in the Verkhovna Rada. The law aims to ensure safety in the workplace and prevent possible conflicts of interest.

According to the updates to Article 142 of the Labor Code, the work regulations may include rules of conduct that require employees to disclose personal ties with persons residing in the aggressor state or the occupied territories of Ukraine and to keep confidential information secret. Failure to comply with these rules may result in dismissal. The establishment of such rules is mandatory for organizations of strategic importance to the state. The law also introduces a new ground for dismissal of an employee — conducting an official inspection, although the Labor Code does not define this term and does not specify the details of the inspection.
